Money Transmission Terms and Conditions

FEES
Nexxo® charges a fee for each money transmission; the fee will be clearly disclosed before each money transmission and collected at the time that money is accepted for transmission.

CURRENCY EXCHANGE
In addition to the fee applied to each transaction, a currency exchange rate set by Nexxo® is applied.  Any difference between the rate stated and the rate received by Nexxo® will be kept by Nexxo® in addition to the transfer fee.

CUSTOMER PRIVACY POLICY
Nexxo® has the highest regard for the privacy of its customers. As a result, we safeguard the personal information of our customers in all areas of our business.  We regularly assess our business activities to ensure that customer privacy is respected. We will conduct our business in a manner that fulfills our promise to all of our customers.
Information Collection:
We will limit the collection and use of personal information to the minimum we require to deliver superior products and service to our customers, which may include advising our customers about our products, services and other opportunities, and to administer our business. This information may be collected from a variety of sources, such as: information we receive from you on forms and applications, and through other means, such as over the telephone or through the online registrations; information about your transactions and money transmission experience with us, our affiliates, or others; information we receive from consumer reporting agencies or other outside sources regarding your credit worthiness, employment or other relationships; and other general information we may obtain such as demographic information. We strive to keep our customer files complete, up-to-date and accurate. At your request, we will supply your money transmission information, unless prohibited by law. If you have a question or concern about the accuracy or completeness of your personal information, notify us, and we will promptly make any required corrections.
Information Use and Disclosure:
We will use personal information, as appropriate in the normal course of our business, to service your money transmissions. We will also use personal information to identify you, to communicate with you, to help us respond to your questions, and to understand which Nexxo® products and services will best meet your needs.
Disclosure to Service Your Money Transmissions:
We may disclose all of the personal information that we collect, as described above, in order to establish, administer and manage your money transmissions, to our affiliates and the following types of non-affiliated third parties: financial and non-financial companies that perform services on our behalf such as check printing, data and transaction processing, or companies that assist us in marketing our products and services to you or with whom we have joint marketing agreements; and others, such as credit reporting agencies, consumer credit counseling agencies and similar organizations. We may also disclose personal information about you, as permitted by law, to non-affiliated third parties in connection with a subpoena or similar legal process, a fraud investigation, to record a public record or as part of an audit or examination.
Disclosure to Offer Products and Services*:
We may share all of the personal information that we collect, as described above, with our affiliates and the following types of non-affiliated third parties, in order to deliver products and services that you have requested or to communicate with you about us and our products and services or about them and their products and services: financial and non-financial service providers; such insurance companies or other organizations that offer products and services that we believe would be of interest to you. You may choose to opt out of this type of sharing by following the instructions provided below in this document.  We do not sell personal information to third parties for the purpose of solicitation. If you prefer that we not disclose personal information about you to our affiliates or non-affiliated third parties, for the purpose of offering you products or services, you may opt out of this disclosure. That is, you may direct us not to share your information with these parties. If you wish to opt out, you may:

Please allow six to eight weeks for your request to become effective.
*California Residents: we will not share the personal information that we collect with our affiliates and non-affiliated third parties for the purpose of offering you products or services.
Former Customers:
If you or we decide to end your use of Nexxo®’s services, we will continue to safeguard your personal information as described in this document. 
Information Security:
Only authorized Nexxo® employees, who are trained in the proper handling of customer’s personal information, will have access to personal information. Employees who violate our privacy policy will be subject to our disciplinary procedures. We maintain physical, electronic and procedural safeguards to protect personal information. We continually assess new technology for protecting information and upgrade our systems when appropriate. Whenever we hire other organizations to provide us or our customers with services, we require them to conform to our privacy standards, to allow us to audit them for compliance and to enter into a confidentiality agreement that restricts the use of personal information to those purposes intended and prohibits independent use of the information.
Changes to Privacy Policy:
This privacy policy may change from time to time and we will provide notice of changes as necessary, as long as you maintain an ongoing relationship with us; however, we will not disclose your personal information to non-affiliated third parties other than as described in this document without first giving you an opportunity to opt out.

PROTECTING YOU FROM FRAUD
Nexxo wants to protect you, our customer, from any Fraud that could occur if you are solicited to send funds to an unfamiliar person. If you are concerned about any transaction, please call Nexxo® at 1-877-MI-NEXXO and we can cancel any unpaid transaction.

After first contacting Nexxo® Financial Corporation, if you still have an unresolved complaint regarding the company’s money transmission, please direct your complaint to the Texas Department of Banking:

NOTICE FOR OUR CALIFORNIA CUSTOMERS
RIGHT TO REFUND: You, the customer, are entitled to a refund of the money to be transmitted as the result of this agreement if Nexxo® Financial Corporation does not forward the money received from you within 10 days of the date of its receipt, or does not give instructions committing an equivalent amount of money to the person designated by you within 10 days of the date of the receipt of the funds from you unless otherwise instructed by you.  If your instructions as to when the moneys shall be forwarded or transmitted are not complied with and the money has not yet been forwarded or transmitted you have a right to a refund of your money. If you want a refund, you must mail or deliver your written request to Nexxo® Financial Corporation, P.O. Box 1089, San Bruno, CA 94066. If you do not receive your refund, you may be entitled to your money back plus a penalty of up to $1,000 and attorney's fees pursuant to Section 1810.5 of the California Financial Code.
